Police in Clayton, New Jersey, confiscated two guns from a woman after she complained about county government moving to raise her property taxes and inspect her property without a search warrant.

Eileen Hart of Franklin Township was arrested and charged with making terroristic threats, disorderly conduct and harassing officials from the Gloucester County Office of Assessment and Appraisal Systems, Inc.

A county tax assessor told police Hart attended a meeting held with Franklin Township residents to discuss a property revaluation program the county instituted to “bring all home values up to the current market value,” according to the South Jersey Times.

Assessment and Appraisal Systems told the Gloucester County Times last August the pilot revaluation program is not about raising taxes. “A revaluation is not necessary to raise taxes,” Ernest DelGuercio, CEO of the assessment company, told the newspaper. “It ensures everyone is paying their fair share – no more and no less.”

Residents have complained the assessment program violates the Fourth Amendment. In order to make revaluation assessments and determine the tax value of a property, company inspectors must enter homes and inspect them. If not allowed to do so, the company often assesses higher values on homes, leading to increased taxes.

Eileen Hart said she did not allow the Assessment and Appraisal Systems to inspect her home because her husband was not present at the time. She also cited religious reasons. Because it was denied access, the company revalued her property at a higher rate. Hart attended the meeting last weekend to complain about the revaluation and the arbitrary move by the county to assess the value of her property.

After she began reciting the Constitution to support her argument, an Appraisal Systems employee escorted her from the public building.

“I didn’t scream, I didn’t yell,” she told the Examiner. “I have the right to air my grievances against the government in a public setting. I’ve never threatened anyone a day in my life.”

“She also wouldn’t let me speak and told me to sit down and shut up and listen as well,” she explained. “That’s when the young man came toward me. I knew he was going to put his hands on me. I saw him out of the corner of my eye. I said to him ‘Don’t you dare touch me.’ Then they threw us out of the auditorium. The young man from Appraisal Systems, Inc. was the one going postal, and I believe if he had a gun, he would have shot me (and my family) on the spot. I was calm the entire time.”

A spokeswoman for Gloucester County said the assessor “has never experienced this type of extreme behavior from a taxpayer” and the police were notified, apparently because reading the Constitution is considered extremist and a threat.

Although Hart exercised her Fourth Amendment right by not allowing an inspection by government without a court-issued warrant, it did manage to violate her Second Amendment right by confiscating her firearms.

After police arrested her, they demanded she hand over her two guns, a .357-caliber Smith & Wesson revolver and a .40-caliber Glock for “safekeeping.” If she had refused, a judge would have set bail too high for her family to pay.

“I have permits for each of them. I applied legally, I got them legally,” she said. “Now I can’t defend myself. I never said the word ‘gun’ at the meeting. None of those people would have even known I was a gun owner.”

So, it is a good thing that her Fourth Amendment and Second Amendment rights were violated?

My experience is that these meetings are ALWAYS taped. Perhaps the tax assessor would like to produce that tape to prove that the woman threatened her . . . I'm sure the newspaper would love to post it.

From experience in investigations and in the legal system, I've learned that government officials are not much different from some of the seedier people in public life. They are willing to "fudge" the truth in order to get a bit of payback. Did she threaten to come back with a gun? Only the tape can tell us for sure, and apparently the county assessor isn't sharing.

Yeah.. The rest of the story adds nothing to the story. Credibility of Assessor? What would make that reasonable? ( They accused Her, the police, as is normal, were nowhere to be found until the "incident" was deep into the past.)

I am with Chad. If there is a rest of the story it is on the tape.

It also shows the ever important fact; when you need help now the police are only 30 minutes away.

HA HA, What? Does that have a point Dano? Or was it meant to make people understand that if something happens to you the cops will not be there until later?

I agree, I will not have an armed escort like all of the head honchos in Washington, because tax dollars do not extend to my imminent protection and I cannot afford to hire one, I bet it is the same in Sweden.

Nice to have someone living in another country worried about how OUR local tax dollars are spent.
 

Yeah right all the people in authority are never on the wrong side, I don't know how many kids here in Indiana in the last few years that have died when they accidently shot themselves with their parents gun that their parents were charged and child protection services called in and then a police officers kid he was 8 accidently shot himself with his dads gun and that was just a terrible accident. Then I believe it was a couple years ago which he still hasn't went to trail yet but a police officer runs over 2 people on motorcycles while drunk on duty killing one and the police union is paying his legal fees, and its too much to go into but if you check into it you should see how far his fellow officers went to cover it up, it was Indianapolis if you want to look.

I had the same evaluation last year on my home in NJ. I also didn't let them enter my home. The assessment raised the value of my home 130,000.00 + of course I went to a hearing and disputed ! I relieved a letter later stating that they lowered their estimated value by 40,000 and if I wanted to dispute it again that I would have to go to court in front if a judge. The assessment company is in the business to make money at our expense. GOOD FOR HART! We have to fight back.

Just for the record, I think that the people making a big deal over allowing them into your home are just making a big deal over nothing. What you should really be upset over are the tax rates themselves and how your property taxes are being spent locally. What good does it do fighting about letting an assessor into your home? Seriously, who cares...

Yes, they came through my town just 6 months ago. I did allow them into my house and my assessment went up about $75,000. The funny thing is, I currently have my house listed on the open market $10k BELOW their assessed amount. So, of course, I will also be filing an appeal. Best of luck!

No assessor in my home. They can compare like properties and what they sell for.
Been awhile since i had to protest an assessment,told the township supervisor i would be happy to have him pay me what assessor valued it at. They have info on previously sold homes and of course what buyer paid. Most have been fairly accurate when they wanted to try.

Really, why allow the goobernment or an agent of the goob in your home to decide how to penalize you? It is beyond me how some eggheads might think that they have no need for any rights that they are given.
 

I will not allow any assessor into my home either.....It's none of their damn business what the inside of my home looks like and what my posessions are. Tax was paid on all of these items when purchased....
