A New York Democrat is working to reduce the number of Americans legally owning firearms by mandating they obtain expensive insurance.

In March, New York Rep. Carolyn Maloney boasted her proposed measure would be “the first bill to require liability insurance of gun buyers nationwide.”

H.R. 1369, the Firearm Risk Protection Act, mandates that all gun owners obtain liability insurance prior to buying a firearm.

“It shall be unlawful for a person who owns a firearm purchased on or after the effective date of this subsection not to be covered by a qualified liability insurance policy,” Maloney’s bill states.

The legislation calls for the federal government to impose a fine of $10,000 on firearms owners who do not have insurance after the bill becomes law.

The law would effectively reduce the number of legal firearms owners in the country and create a new class of criminals. Many Americans would either not choose to follow the law or would be unable to afford the required insurance and would be forced to forfeit their firearms under fear of prosecution by the federal government.

“For too long, gun victims and society at large have borne the brunt of the costs of gun violence,” Maloney said when she introduced the bill in the House. “My bill would change that by shifting some of that cost back onto those who own the weapons.”

In other words, according to the New York Democrat and the sponsors of her legislation, legal gun owners are responsible for violence committed by others. Anti-Second Amendment Democrats have adopted this irrational argument as they move to strip Americans of their firearms following the Sandy Hook massacre.

The proposed law is “ridiculous on its face, as it presumes law-abiding gun owners are guilty for merely exercising a fundamental, constitutional right,” Chris Cox, the executive director of the NRA’s Institute for Legislative Action, told The Daily Caller on Tuesday.

Sounds like a GREAT IDEA to me . . . provided the following provisions are added to the bill:



  1. LEGISLATORS who refuse to produce all documents pertaining to their connections to any lobbyist or other special interest group would be disqualified from holding office higher than street sweeper for a period of not less than 40 years. If they are found (after attaining office) to have hidden that information in an attempt to defraud the American People, the penalty should be a PUBLICLY EXECUTED IMMEDIATELY UPON CONVICTION by a jury OF WE THE PEOPLE.
  2. Any politician seeking office (including but not limited to the President Of The United States) would be required to produce proof of qualification (including proof of LEGAL CITIZENSHIP) before they are allowed to enter any election. If they attain office, and the documentation is proven to be false, that person should be PUBLICLY EXECUTED IMMEDIATELY UPON CONVICTION by a jury OF WE THE PEOPLE.
  3. If a politician is found guilty of any malfesance in office, they are to be barred from any political office for a period of not less than 100 years.
  4. If a politician attempts to bypass the Constitution or Bill of Rights --- that person should be PUBLICLY EXECUTED IMMEDIATELY UPON CONVICTION by a jury OF WE THE PEOPLE.
  5. The above offenses would be judged by a jury of COMMON PEOPLE. Acceptance of PUBLIC ASSISTANCE would disqualify any potential jury member. Failure to provide PROOF OF CITIZENSHIP would disqualify any potential jury member. Conviction of a FELONY would disqualify any potential jury member. Being a member of the bar in any State or Nation would disqualify any potential jury member.

Then, maybe, we could get back to the practice of citizen legislators rather than professional politicians. Then we wouldn't have to put up with stupid stuff like this anti Constitutional / anti Second Amendment foolishness.
 

Yeh, we are required to have insurance for our cars on Massachusetts.
 

In most states your only required to buy insurance if you put vehicle on public highways...

Yep, remember when it wasn't? I was hit by one when I was in college that didn't have ins. Luckily I had uninsured motorist which was an option then. I think they paid me for 1/4 of my totaled truck. I paid in more than the company paid me.

By the way, aren't we required to have uninsured motorist coverage now that everyone is required to have insurance??

Two issues with the proposal.

1) Setting a financial requirement for one to exercise their Right establishes multiple classes which is contrary to the concept of all being equal in so far as Rights under our Republic.

2) Being that the insurance is conceived from the idea that "gun victims and society at large have borne the brunt of the costs of gun violence" we are to assume that one must maintain this insurance for their willful acts. What insurance company offers insurance for such willful acts? It would be akin to filing a fire insurance claim for burning your own house down.

1 Would folks consider the licensing etc for fully auto weapons to be similar to your point number one. Basically driving up the cost of fully autos so much you basically greatly restrict ownership. Frankly probably doing it in a way that has been far more successful than any outright "ban" could have been.

2 insurance for willful acts or insurance for accidents? Would courts uphold this just as they uphold states rights to require liability insurance got cars? Frankly I would think gun owners would carry an umbrella policy rider anyways to cover themselves?

Just a thought.
 

Picker, your second question. many insurance policies don,t cover war,riot, and you,ve likely seen more, covering crime not likely,BUT in my state we need to cover on our auto policies insurance for uninsured motorists or be up a creek should we get in an accident with them. Yes they should be insured(here in this state) making it a crime if they are not but,who's liable? Kinda crazy yet criminals seem to be covered one way or another.
Imposing fees or requiring insurance on fire arms,(Pittman Roberts all ready being imposed or required however you see it at store buys) well never say never, or miss the chance to object.
 

People get hit everyday by low lifes with no insurance. I've got two different friends dealing with it from two different accidents right now. You want a real nightmare, get hit by one of these illegal aliens. No insurance, no license, no habla englese, no see 'em, no MY fault! Drunk as often as not. Just be sure you document it all right there on the scene because your insurance will squeal and run like a greased pig trying to avoid paying on your "uninsured driver" policy.

Yeah, went through that back in the 1980's - couple of DRUNK ILLEGALS hit the car my wife was a passenger in --- actually hit the door she was sitting beside. Neither occupant of the other vehicle had a license and they had no insurance.

Cops did not arrest them, but took a statement and asked for their residence addresses. The next day, I went with one of the officers so he could show me that no one had lived at that address in many months. The owner of the car my wife was riding in was insured, but they never paid on her claim.

Oh fun fun fun. Did I mention that Bill Clinton was the governor of Arkansas back then? The local police were not allowed to arrest those unlicensed illegals, all they could do was take a statement and accept whatever they said without checking.

They are coming after the entire bill of rights any way they can. WE must stay informed, and never relent.
Sent a few more e-mails off today, more coming tomorrow. I always remind them that they took an oath to
defend the constitution. I encourage all to do the same.
 

If you use paper, a pen and a stamp (google them if need be) you stand a MUCH better chance of them actually being seen and read!.....just sayin'. :)

It is email to fax, other end is not even aware it was not sent from a hard fax... One clink to send multiple faxes at same time.

And this is all part of the great AMERICAN political process that our founding fathers created in their infinite god given wisdom. No extremism, armed uprising, FEMA camps, etc, etc. needed. No fear needed.
