You folks all realize that fingerprint technology Fingerprints: The First ID - FindLaw was also protested against back in the 1920's right? Hello? This is 2013 folks. If you get yourself arrested as a suspect in a crime and they book you, taking your DNA is the best thing that could happen to you if you are innocent. And if you did rape, kill, or rob someone 15-years ago but are innocent of the crime you were just arrested for - so what?
Comparing the police being able to do DNA testing on a booked suspect to being a Nazi - really? "Big Brother?" Come on people. I am a lot more angry that I can't LOOK at ice cream without getting fatter..

What about DNA test because you were arrested for speeding? Sorry Terry I think SC blew it on this one and 4 of the judges agree with me...

Each of us has a very distinct pattern of fingerprints. No two or the same. It is the same thing with DNA but more reliable due to bias on those taking the prints and then reading the prints. What is the difference between getting DNA swabbed and fingerprinting? Does fingerprinting violate the 4th amendment?

If fingerprinting violates the 4th than a lot of lawyers have been asleep at the wheel over the last hundred years?!?!?! I guess we will have to overturn and throw out a lot of convictions.
And if the gov wants my DNA - swab away!!

Unreasonable search and seizure. If your arrested for speeding they can take your DNA...... Your DNA gives thousands of times more info than finger prints.

You have not been convicted of any crime. Police need a specific search warrant to search your home, your car, your work place, but not your body?...:banghead:
The fact so many do not see their freedoms being violated and taken away is baffling, frustrating and aggravating to say the least.......:banghead::banghead::banghead:
Remember when the grandkids come up and ask you to tell them about when America was free and why we no longer are, many will have to explain how they surrendered their freedoms before they were born.
I will either be telling mine I fought to keep their freedoms or my kids can tell them grandpa died trying to fight for their freedoms.......

I am not in favor of this ,for the reason that it brings us that much closer to a national database,but in reality they already know where you live ,the weapons you have ,the car you drive your income ,and the websites you visit, if they wonder what your doing they zoom a sattelite in on you ,....then watch out for the drone!!! dna itself may not be too much but combine it with the patriot act and we have no real privacy..... however the people on death row wrongfully convicted wish to hell they had dna

most of us follow the laws of our country created by the wonderful system that our founding fathers put in place hundreds of years ago. This system has seen this country through thick and thin, wars, scandals, depressions for more than a couple hundred years. Is it perfect - of course not. Do I always agree with its outcomes - of course not. But as an American patriot I put my trust in this system of government and the documents, processes and procedures created by our founding fathers.
Do I agree with every Supreme Court decision - of course not. Do I believe that I know more about constitutional law than a Supreme Court justice - of course not (and that is a big difference between us). This again speaks to the naïveté of people who think that con law is black and white. Do you know how few rulings are unanimous without dissent

Terry you can be arrested fir speeding, for reckless driving, for unpaid parking tickets, if your ticketed out of state they can arrest you take you to jail until you post bond, if you refuse to sign a ticket you can be arrested, heck all an officer has to do is say you refused to show car registration or DL and you can be arrested, in Missouri you can be arrested for any traffic violation including seat belt, it is up to the officer.....
It gives the police the power to take your DNA at any time for any reason.....
Terry I know your ex police and I support our local police, with yearly donations, but this is open for major abuse by any police officer if he wants to...
Don't believe me Google it. I lived in Missouri 20 years, officer told me he can arrest for any traffic offense including seat belt.
This is fact based...

Again, let's try and keep this debate fact based.
You don't get arrested for speeding. You get arrested for warrants, driving without a license, or not complying with a police officer’s lawful instructions, yadda, yadda, yadda. The ruling DOES NOT give the police the right to take your DNA, "at any time for any reason." The ruling is VERY specific about the arrest criteria for DNA swabbing. Does that mean a police department can't, or won't abuse the ruling? No. And when and if they do, then you have the right to sue the bajeezus out of them using any one of the hundreds of lawyers that will line up to take your case pro-bono!

Terry I posted just a few examples, are you on record officially saying police can not arrest anyone in any state for those offenses?

Not at all. I am on record saying that the police cannot legally take DNA for EVERY arrest they make, and the criteria for doing so is VERY specific. I am on record saying that 99.9-percent of the time you get a ticket for speeding, not wearing a seat belt, ANY moving violation. If you are stupid and argue with a Cop, you CAN end up in the city jail.
