The law does not pretend to punish or rule against everything that is dishonest. That would seriously interfere with business and alot of our history is being destroyed because of Greed.
According to the ALABAMA Historical Commission's deputy state historic preservation officer, the mound at the center of the dispute is the LARGEST of its kind in the state. The site is at least 1,500 years old and was constructed during what was known as the Woodland era.

I spoke by email with some archy's who did test digs at the mound a few years back. They found really nice pottery and possible burial artifacts. This was reported to the University of Alabama Archy Dept. They said their efforts to stop this dig have all failed.
I contacted Governor Riley's office today and explained the situation with documentation to allow them to quickly understand the situation.
I agree with state law giving the landowner the right to what he wants to with his property.
What I disagree with is that it is the largest mound in Alabama and its being torn down for fill dirt for a Sams club/wal-mart.There were made by the phrase made in America now its all made in China. This is just another example of how low can we go.
They will grind it into the ground during construction with the earth movers. I have seen it done before.

The reports from Alabama were released. They say the mound should not be destroyed and it is very significant. They seem to think it is loaded with burials and artifacts but they are tearing it down quickly for the parking lot.

What an absolute tragedy. If it's the largest most important mound in the state, why not make a state park, or natl. landmark out of the area Oh yeah because corporate greed always wins.
I realize we can't fence off every single piece of dirt because it may have historical significance. HOWEVER, there should be a better way to do this. I am particularly concerned because this site may contain burials. Everyone here should call 1-800-WAL-MART or go to their website and express your concern. This is called a 'Letter to the President'. Mention the store number and location. If you mention the name of a member of management in that store, the complaint goes directly to the district manager. Management is required to contact the complainant, if possible. They shouldn't disturb burials, and I don't really want to have to fight for a parking space over what could be the remains of one of my ancestors. This could be why I was told at work that I 'intimidate' the other assistant managers, but right is right.
If I lived anywhere close, I would give them some of my dirt for fill.
Those developers are so full of @#$%, they should use that for fill.

...and I missed that part about 'used to send smoke signals'. I'll get off this and move on in a minute. It would be more viable to build a huge fire that could be seen at night, which was done. Smoke signals, ha ha. Tell the mayor that mirrors were even better for signalling, as on the southern plains the wind had a tendency to scramble your message. I'm still laughing. I'm on vacation, but when I get back to work I'm going to check into this further. Maybe the matter is already resolved.
I spoke with a Mr.Poovey with the AP press. I can not imagine that this would not be a great story and carried on all the wires. I know that many from here have been trying also.

I know Treasurenet has no problem giving them a little bad press. I'll bet a large amount of the complaints came from views of this thread.
Without releasing any names I can say that I have been notified by one of the city councilman that the mound will not be destroyed and it will be used in a way that the community would approve. While this is good I am somewhat concerned the same individual has yet to make a public statement. Hopefully I was not just fed a line.
By doing some digging I was able to talk to Harry Holstein, the archeologist mentioned in the paper, read the U of Alabama report about the mound and talk to an Oxford City Councilman. The internet can truly be a wonderful tool.
I gathered the facts and then made an arguement for saving the mound. I doubt this had any impact to the events but it was satisfying trying to help.
I think that you are to be comended for bringing this to everyones attention and you becoming actively involved in trying to preserve the site. Here in a forum where we all try to collect and share our finds but yet with the mentality and respect of preservation as well.
Thanks MichaelB. I hope they issue a formal statement other than the one issued by the site manager. Looking at old photographs and current demolition it appears that much damage has been done already . All the rocks from the top have been removed and wonder if they will be replaced.
