I'm HOT! Is the BLM flim flamming me and TimC??

There is no doubt in my mind that TimC knows the LR2000 page better than many in the BLM office-Phoenix. Case in point: He pointed out to me that the previous owner of the two most recent claims we filed for may still belong to the previous owner, even though he was delinquent. The federeal law allowing previous claimants to pay a CURABLE MAINTAINANCE FEE by Dec 4th was excerised by them on Dec 3rd. POOH! According to Tina Coladonato, in the Phoenix office, we are OUT over $400! Tina told me the recordation of those fees will not be posted for 4 to 6 weeks. Tim found them on their website this morning. Even though the Yavapai county records show Tim as the owner, Fed law will supersede. She also told me that the $400 is not recoverable because it is on the claim applicant to KNOW the status of the claim AT APPLICATION, which is impoosible with a 4 week lag time. I'm HOT! TTC

Nope, that's how it goes. It doesn't matter if you are trying to slide into a claim when the owner misses a payment or if you are fradulently filing over an existing claim. There is no refund.

Our government at work. It is unfortunate Terry, not fair, and a very expensive lesson in claim filing. On one hand you can't blame the claim holders for waiting as long as they possibly can to pay their bill, but on the other, the BLM should be able to tell you the status of ANY claim, ANY time - and they can't or won't.
 

That's not right. In our modern day computer recordkeeping format where did your fees go? There has to be journal entry point. Do they have a column for excessive fees recieved? How do they reconcile their books? Is it too late to stop payment on your check? :BangHead:
 

Well, my lesson cost $400 plus. Won't break me but i could use that money for more gold STUFF. I am a little poorer but alot wiser. TTC
 

That really is to bad Terry, I hate to see anyone lose money. The govt. gets enuff as it is!:BangHead:
 

I honestly think we will likely see more of this type of confusing,"Oh well",kind of BS,as they obviously dont give two hoots about any miner,or miners rights......JMHO

WOW. Cali, I never thought of that but.... I'll bet the BLM has and don't forget.... the government has never been known to give back surpluses! TTC

I wouldn't give up. Give 'em $400 worth of grief at least. Best of luck Terry.
 

sorry to hear that Terry C. Same thing happened to me. Actually twice. First time my money was returned minus paper fee of $10 I think. That was in 2010.Then again in 2011. That time the BLM told me the rules were changed that previous fall with the reason they told you and saying no refunds any more. It cost me 200. what pisses me off is that they never tellus of their rule changes until it cost us money.

i have a friend that lives in Colorado and has several claims. he (they) filed for a claim that was shown as vacant,he (they0 did the paperwork and paid. latter it was found to be unclaimable and the department returned his $$$ minus the fileing fee. i had paid for my 2011 dredgeing permit in Colorado and dredged the Arkansa River for my 3 week stay on a friend claim, only to receive my $$ back that winter from that department.
 

Contacting them won't do $hit. You have to either run, or be at their offices or public appearances constantly. Get involved if you want change.
 

Just talked (9:20 am) with a Rod Ebbert from the Phoenix, AZ BLM office. He seemed genuinely concerned with our (TimC and I) situation. To review, TimC and I had our eye on two claims that were in delinquency, in the area of Rich Hill, AZ. No need to touch on the gold potential of this area. The claims went delinquent on 9-1-12, because maintainance fees were not paid. The BLM was supposed to send notice of delinquency but because of MASSIVE amounts of backlog, the notice was not sent. The previous owner did catch up on the fees, called curable maintainance fee, on 12-3-12. The recording of that fee was recorded yesterday. Although the BLM accepted monies from me on 12-31-12, AFTER they accepted monies from the old owner, ON THE SAME CLAIM, I was told I could not recover my monies as it is put on the filing claimant to KNOW the status of the claim filed on. Well, today's BLM cannot even assure the status of a claim because of this massive backlog! Mr. Ebbert said this year's change of fee schedule has created a UNIQUE situation that was not predicted. He sounded sincere in saying he would look into our request to be re-imbersed. Let's see what happens. TTC
