I got ran off the beach tonight by some big biker looking dude and his wife, and their big dog!

I'm digging a signal in the dark out on the wet sand when this big dog comes charging up to me. I jumped up and backed off, turns out the dog was only curious. Gave me quite a scare since I have been attacked by dogs running loose 3 times in the last few years.

Grrrr I look around and there is a lady standing at the top of the slope up on the high tide sand. I say is this your dog? She doesn't say anything. I say dogs are not allowed on the beach! I would not have said a word if the dog was on a leash and the owner had control of it.

She comes over yapping at me about how she has lived here 20 years. I say I live here too and dogs are not allowed on the beach let alone the dog isn't even on a leash. She says something nasty and walks off, I go back to metal detecting.

A couple minutes later she comes back, she's yelling at her
husband, "we have a problem over here". Here comes this big biker guy about 6 foot plus 280 or so. He says what, she says, "we have a problem right here pointing to me". I'm thinking oh great.

He comes over and stops about 10 feet from me and asks me if I have a problem. I say no, but dogs are not allowed on the beach. He says yes they are after dark. I say well it doesn't
say that on the signs.

He starts mouthing off about how he's lived here 20 years, he asks me if I live here I say yes. He says well my house is right on the beach so why don't you go f yourself. I say okay fine, you know have a nice evening.

He stomps off a few yards then turns and says go f yourself again, I say thanks. They walk on down the beach and I go back to detecting. 2 minutes later a ball comes flying past right in front of me with the dog right behind it. I decide to leave.

I walk up to the top of the slope, turn my machine off. Big creep dude follows me. He continues to follow me half way back to the parking area. I say nothing.

I call the cops when I get back to my car and they confirmed, dogs are not allowed on this beach at any time. I tell them about this creepy guy and his wife and they sent the cops right over there. They have about 20 cops patrolling this 1.5 mile beach so with any luck they caught up to the creeps and booted them.

I don't care if the guy does live on the beach, does he thing he's a special case or something? The law applies to everyone but him?

I tell you thats the last time I leave my cell phone in the car, I could have had the cops over there in a minute or two if I had my phone with me. I'd still be detecting and they would be gone or in cuffs.

If you had taken your cell phone out, you would probably now be the owner of a two-piece cell phone. ;D

I beach detect and was leaving my cell in truck so it was safe, Then i was at Dicks Sporting goods and they carry water proof thin pouches that u put your cell in and carry around your neck,It works great at the beach
 

Charles...That sucks dude!  As I hate dealing with people like that...I am not one to back down or get ran off by anyone.  Unless it is illegal to detect where I am, or it is private property, I am not budging.  Im not going to let some dude with a bad attitude ruin my day!  However, you did the right thing!  That is the exact reason I got my concealed pistol permit, guys that have to make a big deal out of nothing and would have no problem trying to ruff you up just to make themselves feel better about life!  ::)
 

Just remember that if you choose to "stand your ground" on a beach at night with an burly biker dude protecting his woman, you may be right. DEAD RIGHT.

There was a newscast, and a few newpaper articles, not too long ago, about property owners keeping people off beaches

The thing is, I was in the middle of the mile long 'public' town beach and there are no homes there! If he really owns a beach front home it would be worth a lot of money and I'm sure a lawer would take an interest in him sicking his dog on me. He better be careful or he'll be taking out a second mortgage. :D

Storm I hear you on the concealed cary permit, I was thinking about that immediatly after this event.
 

When we are out at night detecting we are the topic of the "night people" that think they may lay claim to anything they want. The dude may have been a nice guy if his woman didn't ruffle his feathers most of the night about not having a job, bike in the living room, etc. Guys can be put in a bad mood and he had to show her who was boss of his beach.

It's best to always hunt with partners when at night or in a bad area, guys like Smith & Wesson.
 

An unpleasant experience but at least it was not a privately posted no trespassing sign. In my area we have had more than a few private citizens/condo associates post these signs in public areas of the beach. By law anything below mean high tide is public. In some instances the signs ran from the private property all the way to waters edge in an attempt to prevent people from walking the particular section of the beach.

Unless complained about the county does nothing about it. One group posted these signs on the south end of turtle beach, an area that had been open to the public since the county's inception. Of course the complaints came in immediately and the signs came down.

IMO there seems to be something inherently unconstitutional about condo and homeowners associations in general. I wonder what the extent of legal challenges these groups have faced. Maybe I will do a little research on that after this mornings hunt. At any rate they seem to have a lot of nerve and virtually no fear of what the ramifications of there actions may entail.

You would think that just as there are legal consequences to ignoring a no trespassing sign there would also be legal consequences to the posting of these signs on public property for private reasons, especially when an attempt is made to enforce these improperly/illegally posted signs
 

I feel like I am compelled to reply to this post. I have only been detecting for a short time but I have some strong feelings about the whole bully thing. I also am not one to back down from some coward trying to bully me. I feel that if you back down from a bully you just empower them to continue bullying people. We as people can not continue to allow the bullies to dictate what, where, and when we are going to do anything we choose to do within the law. Some people may choose to run away or avoid a confrontation. Myself I choose to stand my ground. I also have no problem getting "down and dirty" with anyone,of any size if that is what it comes to. Bullies beware, this detectorist does not back down.
Usually I will try to calmly talk my way out of a situation but if that does not work then let the fur fly. Yes you could end up in a pine box, yes you could get the crap kicked out of you, but you must stand up for your rights or they will be stripped away from you by the bullies of the world. Do not get me wrong here. I am not looking for trouble, but if it comes my way it will be dealt with one way or another.
I do not advocate looking for trouble. I do advocate standing your ground and standing up for yourself and your rights though. Just imagine if the founders of this country had backed down from the bullies of their time, we would all still be under British rulership or worse.
 

Charles, you did the right thing! You stood your ground and had great judgment on when to say it's not worth it and go back to your car. The evening out is not fun anymore anyway, so by letting the authorities handle the situation was the correct choice at that point. An earlier post says that by backing down it only empowers an individual is a correct statement. However, you laying on the ground from a physical confrontation will also empower that individual and maybe more so. You did everything correctly from standing your ground, to using your head and knowing when to call it a day

I figured out why the guy was so pissed at you. You know that nice diamond ring you found, might have been his wife's...LOL
You know I'm only kidding with you, but seriously, next time you detect that beach carry some dog biscuts in your back pocket just in case.

Where is there beaches in western NY?
 

I would seriously be watching your back for a long while as this guy may seek revenge on you for calling the cops. I hope not, but be careful Charles!

I have had a few run ins with nasty people, they are never fun and I usually take the passive way out and just leave. There's always another day to hunt, expecially if you are out numbered.

as soon as it smelled of conflict i would have dialed 911 and advised the dispatcher that you feel you are in danger and started describing the guy as he stood infront of me. if he did beat you down at that point they got the description and most modern phones automatically turn on their gps units when you dial 911. description, location, possible arrest. soo much for mister tough guy.

living in miami i've had plenty of chances to try this method and it works. one of the better stories.. i was sittng in traffic on a major roadway (US1) and two guys decide that they are going to get into a fist fight in the road (roag rage!). i got out of my car with phone in hand and yelled at them "you A**H**** better get back in your cars and stop blocking the road or i'm calling 911 and reporting it." they quickly zoomed off.

being in your shoes, i wouldnt return to that beach without a detecting buddy to be your eyes and ears.

i personally wont detect beaches alone at night and wont wear big goofy headphones that block out outside sounds. you're a sitting duck when you have your ears covered.

All though they express their view in different ways. :)

I think your judgement was right on. As frustrating as the situation was, you weighed your options and the potential costs of your different choices. You blew the A.. H... off and used your tax dollars and brain to handle a situation that could have resulted in a big legal mess. I commend you on your judgement and self control. I also appreciate that you represented metal detecting hobbyists in a strong, but peaceful manner.

I agree Steve, brains over brawn. We are not in junior high anymore, things are a bit more serious in the grown up world. While this idiot was busy telling me to 'f' this and that I was weighing my options and thinking 4 steps ahead of him.

1. Dial 911, damn it my phone is in the car.

2. Bury my 6 pound stainless steel scoop in his skull? No, its their word against mine, no witnesses, he's on a stretcher to the hospital and I'm in cuffs bad idea.

3. React to his verbal assault by telling him to pound sand? Nope now I lose the high ground. Again no witnesses, if I get beat to a pulp they just say I started it. If I lay him out on the sand, no doubt I'd have to take on the wife next and maybe the dog, again I may be in cuffs.

4. Ignore the profanity, verbal assault, and try to walk away, call the cops and report the incident. Do what any judge would say you should have done. Threatening me with his dog, verbal assault, stalking, that will cost him thousands of dollars at least. Drag the moron into court where a judge can order him to sit down and shut his dumpster lid.

I'll follow up with my new friend the police lieutenant. I'm pretty sure he won't be happy to hear some thug is bullying people and chasing them off "his" beach.

That was my first thought, I was really kicking myself for not carrying my cell phone. There are a dozen cops up on the boardwalk only seconds away.
