Setback for Spain in the 'Odyssey case'
A Florida court rejects Spain's petition to obtain information on the treasure of the 'Black Swan'

Odyssey Marine Exploration, the American company specialized in the search for underwater wrecks, will not have to give Spain more information on the Black Swan, the treasure that it found in May of 2007 in some point of the Atlantic Ocean. At least for now. Thus the judges of the Tampa Court that carry the case have determined, who consider that the confidential information provided by the company to Spain's lawyers is sufficient and in accordance with legal procedures.

In a document made public yesterday by judge Steve D. Merryday, the magistrates reject the main petitions made by the lawyers for Spain in the case of the boat found in some point of the Atlantic. The Spanish authorities, that suspect that the wreck found by Odyssey is Spanish patrimony, requested through their attorneys more information on the exact location of the place where the company found a treasure of 500,000 silver coins. But judge Merryday is not in agreement. Furthermore, if Odyssey complies with all the procedures to finally reveal the identity of the wreck, in accordance with the requirement of the judges, the company will not have to offer for now any more information. In other words: the judges tell Odyssey to determine soon what it is it has found by, while this happens, Spain does not have a right to more details.

The judges also reject some of Odyssey's aims, specifically to be compensated by Spain. The company argued that Spain must repair the economic losses suffered during the retention of its ships in the port of Algeciras. On this matter, the judge did not pronounce in favor nor against. He simply said that he has no jurisdiction over this cause.

Despite the setback received by Spain, that hoped to obtain more information today on the treasure, Spain's lawyer in the United States, James Goold, sold the news as something positive and tried to disguise it as a victory for Spain. The attorney showed his satisfaction at the judge's decision to reject the aim of Odyssey to claim damages and injuries from the Spanish Government for its actions and assured that the judges have forced the company to "provide the additional information that had been demanded".
