NJ: something to be upset about

When they ask you tell them you dont answer questions thats the only way to deal with cops say nothing and answer nothing let your lawyer handle the questions ...95% of what the cop knows comes from your answers so take it out of the process

I didn't say "talk to cops"...I said, "don't lie to cops." Heck, tell them you just got in an accident and feel bad. Keep repeating that statement over and over until they send for an ambulance and send you for a stat CT scan. Lying to cops is just plain ole not smart.
 

Seriously though, I think they should be able to access your phone and check just the time period of the accident. What is the difference between this and giving drunks blood, urine or breath tests?? People on the phone are as dangerous or more so than drunks but nobody wants to admit it. Everyone just has to have their freakin' phone whenever they want.

Not all violators of cell phone in motor vehicle rules are created equal. Here in NY, I routinely see police driving around talking on cell phones. Why can they do this and not cause accidents? I think it's because they use a little common sense and I think there are plenty of situations where people can safely talk on cell phones and drive. It's been criminalized in response to really stupid people who don't use due care. Kind of like the gun laws that are imposed because of the actions of a few evil/irresponsible people.

I didnt make my reply to anything you have said but your right its a very bad idea to lie to a cop you will be in some serious trouble...i only stated dont talk to them and dont give them and answers to any questions even if its as stupid as where are you coming from or where are you going...there not your friend ..there not there to help you...they are there to gather information and make money for the state if you dont give them any information besides your id they have alot harder time pinning something on you ....its your right to remain silent and its your right to have a lawyer there when questioned so know your rights if you want to use them
 

In the past few years I have been seeing a lot more rear end collisions than in the past.
It usually means the driver that hit the car from behind must have been distracted.
Being the victim of someone's negligence in a car accident is at the least very very inconvenient. Let alone what it will now cost you on your insurance. I think if you believe someone was distracted by being on their phone while driving and caused you injuries you should be able to get their phone records just for the specific time the accident occurred. It is against the law in most states to be texting while driving. It is also usually against the law to talk on a phone while driving unless you are using a hands free device. Lawyers should have to get a court order for such a thing.
You don't need to see phone numbers or even text messages just the times if they occurred during the time of the accident. The phone company could send a document with just that information. I don't think that would violate anyone's privacy rights.
It would just help protect people who were injured by distracted drivers that were negligent by using their phone while driving.

Those conversations or text's are they really yours? You are actually renting time from your provider, it really is not yours per say. After you hang up it's now the property of your provider who can do what ever they want with it. Like giving it to the great OZ.
