NJ: something to be upset about

I'm against searching phone records for no good reason but I am tending to leaning towards okaying this. So many tragic accidents happened because of distracted drivers texting or talking on their cell phones and its not going to stop unless the law steps in.The content of the call is not important,just the fact that they were on the phone at the time of the crash.

First we have mouth DNA swabs, now this?

To me, it is a blatant 4th Amendment violation as well as a possible 5th Amendment violation.
 

I'm totally against the mouth DNA swabs and I do understand where you're coming from. It's the invasiveness for no good reason that I highly distrust. Think of it this way Ben,what if you had a family member that was hurt or heaven forbid killed in a car crash ,needed help with medical bills and driving or texting while driving was against the law in your state? How could you prove fault if the police weren't allowed access to prove whether or not the driver was impaired while driving because of being distracted?

Please keep in mind that much of this argument that YOU OR I could make could very easilly be interchangable with gun restrictions, etc.

JB I'm under the impression that checking the cell phone is only done if bodily harm is applied. Or if the car needs to be towed. 9 out of 10 times the cops don't even show up on a fender bender. I think the ambulance chaser lawyer's pushed for this. not the Government.

Either way it is a gross violation of our rights. It gives the police the right to seize and search phones for every scratch and dent that happens. It is another way for law enforcement to abuse power.
 

If your phone has a password lock on it, ae we forced to hand over the password? Are they allowed to access everything in the phone? What about your email and facebook account - it is in the phone!
 

Seriously though, I think they should be able to access your phone and check just the time period of the accident. What is the difference between this and giving drunks blood, urine or breath tests?? People on the phone are as dangerous or more so than drunks but nobody wants to admit it. Everyone just has to have their freakin' phone whenever they want.

They can check your provider and see if you were on a call they don't need your phone.

We need to stop giving government permission to or condoning them spying on us...

THis proposed law is DOA> NJ lawmakers can propose anything they'd like. And, some really ridiculous stuff gets proposed for equally ridiculous reasons. AS TH has pointed out, the ability to track phone usage times already exists.

How stupid does it get? A few years ago a young boy between ages 8 and 12 was injured when the front wheel came off his newly purchased Wal mart bike. The axle skewer had not been tightened. A lawmaker proposed a law requiring a second lock on the axles of all bikes sold in NJ. Bike manufacturer's, along with advocates correctly pointed out that there was nothing wrong with the current single locking system. That the boy's parents had acted recklessly in not properly tightening the wheel.

That piece of leigislation went nowhere. But shows just how ridiculous things can get. Had the law passed it would have become impossible to buy a bicycle in NJ. All because of one set of stupid parents and the fact that they were personal friends with the state assemblyman who proposed the new law.

Honestly who lets their kid ride anything they as parents haven't fully checked and rechecked? Had these parents done that they would have noticed that the wheel was loose.

Vt. just recently had a case such as this. A young lady,(19), while driving hit a lady out walking her dog. The dog was killed and the lady is now confined to a wheel chair. When asked if she was texting at the time, she denied that she was, even though the pedestrian said that she was. Long story short, the investigators, with a court order checked with her provider and found that she had been texting right before the accident, at the time of the accident, and immediately after. She is now serving time.

I myself, having only the simplest of cell phones, that is turned off most of the time,( for this very reason) cover myself thru non-use. I also understand that some, if not most can't get through the day without the phone attached to their ear. What I don't like is the disingenuous assumption that it is alright to moniter everyones phone and internet traffic. It seems that the common consensous of the govt. is to that anything they do, and say it is for the benefit of the whole, is stretching the meaning and definition of personal rights and liberties! If they are not stopped now, they will continue to think they have the mandate of the citizens to continue the expansion of this police state, and we'll all just get along fine.........NOT
 

well if I were in an accident, I would immediately hide my phone.
& ask someone else to call for help.

If the cops ask if I have a cell phone..... NO :dontknow:

are they going to call every provider & tell them my name & address & check ?

all the cops need to be worried about if I am in an accident is filling out their
little accident report & go on their way imo

I'v never been afraid to lie to cops,
& I wouldn't start worrying now

I know,it's a Catch 22 situation(no pun intended)but a gunshot wound is not hard to detect as compared to a phone call that might or might have not been made minutes or even seconds before impact so I'm having a hard time relating these two instances. We're all up in arms about people registering their weapons but as is proven time and time again,criminals do not register their weapons.GMD get out of my head.

Yes but the crux is that a bike weighs what,a little over 25 lbs. ,is usually ridden by children and a car weighs several thousand and a license is required to drive but yes,ridiculous for sure.you can take all the precautions and still an accident happens.

When they ask you tell them you dont answer questions thats the only way to deal with cops say nothing and answer nothing let your lawyer handle the questions ...95% of what the cop knows comes from your answers so take it out of the process
