Mining claim partnership

I'm looking for advice about what experienced people would do in this situation. I keep hearing horror stories about partnerships.


Last year I acquired an underground mine. I thought the guy had passed and that's why it was let go, but then found out he was alive. In the last few weeks we got in contact. At first he swore he paid the fee and spent a week trying to find receipts, and talking to BLM/lawyers. He called me again and said he thinks we can come to an agreement without involving lawyers and partner up. He knows he didn't pay the yearly fee and admits the cards are in my hands.

He seems like a very nice guy. He has an immense amount of history and knowledge (having had the mine in his family for nearly 30 years), and an approved NOI, as well as a lot of money at his disposal. He's put hundreds of thousands of dollars in this mine. And while he doesn't want to give me specifics until we agree on a partnership, it sounds like an enormous amount of gold has come out of there. He spoke of at one time thinking of selling it to an interested corporation. Talk of an old vein/drift he was trying to get on with very high grade, etc.

After all the bad stories my gut says no, don't involve him at all, but my heart says yes. I feel really bad for this guy. He's a lot older and not in great health. When he thought he still owned it he mentioned wanting to partner with me. If his story is true that he's been waiting on an NOI just to screw up and lose it not long after it got approved....ouch.


Where do I even begin with this? It sounds like with his financial backing, knowledge, and NOI, a partnership would likely allow us to get in and mining immediately. By myself, I may struggle getting much done due to lack of funds and knowledge of the situation.

But I've been warned about "subtle takeovers" and a lot of other legal things that could be used against me to take it back or at least gain control if he's on the paperwork at all.


What would you do? How would you protect yourself? If I could 100% protect myself and retain control I would have no problem splitting the gold or working something out to keep him involved in something he's so emotionally attached to. If this was a small hobby operation rather than a possible full time job operation, I wouldn't care so much.

Has the 'New owner' described in writing and recorded both the "Claim" as well as the "Discovery" at the County records office yet????????
I believe he has stated that he has a valid claim and requested that you stop questioning the validity. He said he has a mineral attorney.
 

My suggestion is to keep things good between you and the previous claim owner. Take some time to clear the collapsed portion of the audit yourself and shore it up. Beware of the potential for backed up water. If you recall the Gold King Mine environmental disaster. A good percentage of audits have water to deal with. You really have not a lot to go on that this is a full time mine other than stories. You really need a sample of the exposed vein. Get a handle on what you REALLY have before making decisions. Unfortunately you may have to haul the material off since the USFS is involved. Surface disposal of the tailings is kind of an issue with lode mines on public lands. Mine tailings are highly likely to be sources of contamination if tested. If you have dry barren audits or shafts on your claim, those would be great places to get rid of tailings.

County records has nothing other than the recording the previous owner filed over two years ago. If you have some actual sources of this “check up”
What you’re referring to is the mineral discovery requirement that should be done before recording. I would absolutely love to be proven wrong and see that anyone is “checking up” on that.

That may be your biggest hurdle..what to do with tailings. You have subsurface rights..USFS regulates the surface rights. That’s usually where they get you. But to my point, figure out what you really have before making plans.
Perhaps the 5 acre NOI in the past could shed some light about this point?

The question was about bringing in the past claim owner. Respectfully, you have gotten off topic trying to prove/disprove the validity of the OP’s claim.

The timber is protected as sacred here in California. Even after it burns, the standing dead trees are defended as critical habitat, left to rot.

I’m not trying to throw a wet blanket on things, but occupying and cutting timber are the two things they fight the hardest against it seems.

Maybe the president will turn his focus on mining and logging public

I was planning on doing an NOI for occupancy but not timber removal. It sounds like dead trees in another area in the best bet. I wouldn’t dare remove timber from around the mine…

FWIW, its BLM not USFS. Can forestry get involved in BLM land? I seem to be lucky and have the one BLM guy that wants me to succeed.. as long as I follow the law. He’s been incredibly helpful linking CFRs and giving advice on how to make it happen, even telling me… well I wouldn’t call them loopholes. But how to “qualify” for occupancy.

There are lots of successful joint ventures. Usually one person is furnishing something the other person needs.

Some people simply are not able to get along with other people due to their personality. If you’re that kind of person - STAY AWAY from partnerships.

Trust your gut is typically good advice. However, success is usually not achieved without taking risk.
I have a guy from another state that is a friend of a friend and it sounds promising. The original owner went MIA on this whole things. But this guy has the equipment, knowledge, and is a logger that can cut timber, so we may do 50/50 without him even wanting claim ownership, using his equipment I can’t afford, and we both gain. Gut is saying we’re both easy going and benefit. So it may happen. But I do appreciate the warnings about people. Too many horror stories to not take into consideration

Respectfully I have asked some questions on this topic thread and one other by the OP. The few answers so far point out the "claim" owner on the face of the "Records".
I have no interest in the prove / disprove validity that is now coming up or being pointed out.
 

You really need a sample of the exposed vein. Get a handle on what you REALLY have before making decisions.
Well this is the extent of my knowledge so far. The vein 20’ In from the portal had this in a 10# sample, and that’s with my table being screwed up and likely missing a lot. From microscopy checks, I also have a lot of small gold. For some reason it only caught the larger gold. Work in progress.


If they walked past this for 30 years I’m guessing they had richer material to work… considering 700’ shafts… far richer.

Thanks for the advice. In the last 10 years I see at least 3 location notices from the same guy. Probably because this isn’t the first time he let it lapse?

There are, I am sure, quite a number of people following the thread, and I firmly believe they would also appreciate the absence of your input.
The OP has made constructive conversation now with two different topic threads as well as this thread with each topic.

There is perhaps a number of reasons why there may be a number of people following both threads as that is the main purpose of the forum.

The OP has pointed out other topics beside the topic thread itself that is likely off of the topic thread.
The thread is titled "Mining claim partnership" with each of these words and phrases are likely "Defined".
