Hypothetical scenario

Only reason I could see for the land owner to deny you if he has been promised a chunk of the find is that it is traceble to a Felony or other crime...Who knows...back in the day someone could have killed someone else for thier loot, and burried it till the heat died down, then forgot where they put it, or died before they could recover it...
You never know, but believe me, you do not need the headaches of hunting private property without permission, especially when the owner knows your intentions.
Other reason may be, he/she now knows the cache is there...They want to dig it up themselves...
You never let on that you know there is a cache on a property..you just ask general permission, that way, when you find the cache, you act all surprised, and offer the owner a cut.
 

Technically, in most areas, if you find a cache and you can figure out who it belonged to, it has to legally go to heirs. If heirs cannot be found, barring a prior agreement, it has to be turned over to the landowner, unless the govt decides for some reason it's theirs (ie anything that could make you significantly more wealthy they will take and give some BS excuse...drug money, stolen coins, antiquities). So in the end what you will have (should you track down the heirs to the fortune and give it to them) is a trespass charge and a confuscated detector. In addition, let's say you can prove that you are the heir to the person that buried the cache, you will still have to pay an inheritence tax, and the landowner is going to tell you they want part of it or they will prosecute you for trespassing. I say do one of three things. Quit talkin, dig the sucker up at night and keep your mouth closed, or get permission from the landowner with a waiver that says whatever you find you can keep, and keep your mouth closed, or go home. Any way you slice it, a large find is going to attract the attention of the landowner, heirs, and the government, even if you've got all your ducks in a row before digging it up. They are all jackals and will take every coin if they can whenever they can. Look at all the trouble they had with the SS Central America. Before they even got the back to the dock, there was a slew of insurance companies (apparently offsoots of the one that had insured the ship originally) were laying claim to it. On top of all this, that was a maritime find. I think for the most part maritime finds, are finders keepers, but you may want to ask grubby on that one. Jackals, every single one of them. I think the court found in the end that if the insurance companies wanted it, they should have paid to salvage it, rather than let someone else do the dirty work then claim it. Dirty rotten jackals. The finders kept over 90% I think.
