How Do You Interpret This ???

I bet if you offered t pay taxes on each hole that you dig they would not only let you detect they would loan you a backhoe to do it... Laws like this just waste paper and time...
 

One thing that I learned a long time ago about asking a question, and asking for permission to do anything.

Never ask a question of a person that can't say YES. By this I mean, you don't ask for a loan from the teller, you ask a loan officer. At the park, you don't ask the gate keeper, you ask the park manager. You don't ask you congressmans aide, you ask you congressman directly. I hope you see where I'm going with this, simply make sure your talking to the right person, the chances are that you are more knowledgable of the laws then the rank and file workers making minimum wage.
 

Gmd52, good point. However a few human psychology things to point out: A lot of those people you allude to thadon't have the authority to grant a "yes", will still do it anyways. They may not know (or care) that that's not in their say-so power . I've gotten LOTS. of "yes's" from lowly ranch-hands or fieldworkers or gate-keeper types . And ... true ... although there may be someone higher ranking man them, I do not argue with their "yes". ;)

The other thing to keep in mind, is that the top dog you refer to, can just as easily say "no". And THEN the problem becomes you're left wondering if that's an actual rule or law, or simply his whimsical arbitrary opinion ( and might never have cared till you'd asked)
 

It almost reads like you can use and posses a MD with a permit...But ya better not dig up anything with it !!!!!
 

I look at it this way...if its public land just detect it. If its a federal battlefield site or national historic site, than stay away. BUT in a public park, Tom is right. If you dig a hole and leave it just how you found it, what can they charge you with? Id risk paying a $500 dollar fine to see my case in court. Afterall, ballplayers and dog walkers are just as guilty. We need to stop worrying about if our hobby is violating the law and just go about it as usual. IF you think you are breaking the law retrieving a coin, than obviously you are not leaving the place as you found it.
 

We use to have a law here in Austin,where if you wanted to sell weed (pot),you had to have a pot stamp,about $50 each,but if you bought the stamp that ment you were guilty of selling pot,which in turn would get you arrested:icon_scratch:
 

That "marijuana stamp tax" thing was a federal program in the early 20th century (before outright prohibition). As it was done then, you had to actually bring your crop for inspection to get the stamp, so you would be in immediate possession when they arrested you. Horray for congress, right?

First you need a license to MD in a city park...then after you get your license you can't dig if you have a metal detector? Why should I get a license then?

because if you get caught with out the permit,(even if you didnt dig) you can be fined more than the permit fee
