Hi everyone and hats off to you guys for your dedication and hard work, thanks to you, newbies like me are easily enlightened and become a part of the furniture.

Say I know where the San Miguel is, given the fact that I hold a proper permission for metal detecting and the area where the ship is found is not banned from treasure hunting, you imagined that? now, I decided to claim the thing and go down the legal path, where such claims are made? should I approach the American embassy in Spain or the Spanish exterior ministry? do I require a lawyer or bring my own one? Do I take with me a bar or two or just a picture will do? What sort of documents and papers are involved and how long the damn process take? Is it negotiable? Do I have a say in the terms and conditions before the claim? Are these people trustworthy?

Can someone please shed some lights on these questions. Thanks.
 

To file an Admiralty claim, you must provide at least something from the wreck, not a picture.

You have a bar or two?

I doubt you will have little trouble securing representation to do this.

Khayboub you must submit your plans to the Ministry of Culture. You better have a Spanish lawyer familiar with admiralty law with you. Proof of your find like a bar will help. Do you have a corporation? Do you have a business plan? It better not mention the word "treasure." The process may take one year. It is non-negotiable, the Minister of Culture will dictate the terms, you need to have a marine archaeologist on your staff. Spain is untrustworthy. After all your work, they may claim everything and give you nothing! Good luck. Is this off Vendabal Beach? If it is, someone else also found it.

If the bar or bars were found in the location that Salvor6 asked about and it is correct that someone else already found the San Miguel, then pack your' bars away and keep walking. Don't tell anyone and least of all the Spanish Government.

Unless you plan to pirate this under radar.... ( which no one recommends but some choose this path)

Otherwise, in my opinion the only way to do this is get a recovery company to do it right and let them fight the big battles, you might make some money but the lawyers all round will make a bunch, as always.

Well I'm not planning to go down the piracy path, I think the historical and cultural significance is way more valuable than gold, you can't put price on it, it's priceless. Is there any lawyers specialising is shipwrecks....?

I can put you in touch with a very high integrity guy that owns a much smaller but successful Odyssey style company who have lawyers and recover people in place.

The LAST thing you want is an Odyssey style of anything. That business model is the definition of insanity, repeating the same thing over and over, expecting different results.
What is left after selling off all of the search equipment to pay debt.

I understand where you are coming from! If you care nothing for your work and information (location) you have and/or don't want any recognition for making the find, then just drop the bar or bars and info in Spain's lap per see. However, if you think you should be and want to be rewarded for your work and information and/or want recognition for making the find, then once you notify Spain and open the lid on that barrel of vipers, you will never be able to get the lid closed again and will likely get nothing for your work and information. They might even try to or actually arrest and incarcerate you.

It seems to truly upset you that anyone other than Jim Goold himself should have a say in this potential shipwreck find and the rewards of recovery...
While we all remain anonymous in this forum..it appears that you have more than just a casual relationship with Jim Goold and the Spanish government.
It will truly bring a smile on my face ....the day that Mexico... Peru..and all the other cultures that were raped and pillaged by the Spanish peoples ...are taken to the world court and made to relinquish their ill gotten gains...and make reparations...

Wow, you are sooo witty, now, pay attention. IF it is the San Miguel, it will be Spanish, correct? If Goold is not representing the recovery team, he will be representing Spain, correct? Is that clear enough for even you to comprehend?

Who knows of anyone who was sucessful against Goold in these matters?

While arrogance is a good quality in a lawyer...and stockbrokers....

Would the Spanish have loaded all the stolen treasures onto the I'll fated ships ...if they had known that God was going to sink them ?
Even juggernauts run out of steam...you never really know..
