I get this message from him '' Hello I've received my package .concerned that is broken and pieces missing ? ''

I respond "
If you are dissatisfied you can send it back & I will give you a refund .''

He writes back ''
The bottom piece of thermometer that holds mercury is missing .there was no
Mercury in box .i took pictures of package .measured it from pictures you posted .here is 3/4 of an inch missing . Package was not opened in shipment that I can see . I've checked with post office this cannot be shipped broken back
To you . It is now listed as contaminated .''

I respond ''
Hi , I'm sorry it broke , can you sen me a picture of the broken part ? Thanks .

He writes back "Email me so I can send you pictures . Rokonman1@ "

So I did his request the next day he writes back '' did you get the pictures ? ''

I checked email on all 4 of my computers - Nothing

so I write him " No, I have not received them . Can you try sending them through ebay messages - there is an " ATTACH PHOTOS" options you can use . ''

4 days later (today) I get an ebay message from hlm " eBay does want us to share pictures .ive tried all week end .iam not happy ! Buti did receive the item broken .ill write it off ''

I'm thinking I should give him a refund so I don't get my first negative feedback . It almost seems like I'm dealing with an 8 year old kid . His feedback score is 37 100%

Hmm..hard to say mojjax, there are so many people out there and were dealing with individuals who we have never met face to face, hence..hard to get a true reading on them and where theyre coming from. It seems either he just likes to whine and craves attention, or yes he's 8...maybe both. If it were me, and it had arrived broken..dang straight I'm gonna ask for my cash back, so who knows whats up with the "i'll write it off" stuff. Maybe that makes him feel he's the CEO of a Fortune 500 company and he's swinging the big checkbook around. At least you'll only be out the $17.70, ive seen much bigger losses so just chalk it up to experience, maybe block that bidder after having the communication issues. Thanks..hope for the best..ddf
 

Ooohhh i feel the "you contaminated my house lawsuit bubbling" But I will settle for $1000.
 

Just from experience give him a refund. You are probably being scammed it happens all the time.
 

It's better than having to refund $200 to someone because they said they received their Roseville vase broken. Then when you get it back, you see they actually broke it with a pair of scissors or a knife trying to get it out of the bubble wrap. It was physically impossible for the vase to chip the way it did, wrapped the way it was. Nonetheless I had to refund their money. They were put on my blocked bidders list and that vase is still sitting on my back porch and it reminds me of how dishonest some people can be, every time I look at it. I now put a note in all my packages that contain fragile items (which are always wrapped in bubble wrap)... "Please use extreme care when unwrapping this fragile item. It is packaged securely enough to be shipped around the world and back if necessary."
 

Personally I would say screw 'em. If they can't get a picture to you of the broken item either through email or ebay, something is fishy. I mean seriously, who is going to check with the P.O. before sending a package back? He's got an excuse for everything.

So far I've been lucky and haven't received any negatives. I have issued a few refunds and partial refunds, but on the refunds I have gotten the item back. I'm not going to be scammed just because I'm afraid of feedback.
 

What about calling him on the phone and after you kind of get a feel for his motivation, then deciding whether to refund or not.
 

I refunded without pictures once for an item under $10. I regret it. If there is no mercury in it then why again can't it be shipped back??
 

Sounds like he is pulling a fast one on you …. I would not refund unless he returns it or has pictures of it … He could take pictures and mail them to you .. Or will not the P.O. allow pictures in the mail >>>
 

My feedback isn't worth risking $10 for.

I shipped a large carpenters plane once. When the lady who bought it told me it broke I assumed it was the handle. No, the post office broke a CAST IRON plane! We worked something out and I over package now and most of the time insure. When one of my insured items was called broken all I had to do was have the buyer show it to the post office. They wouldn't and Ebay sided with me on the claim.

If the buyer won't provide pics, I doubt ebay would side with them. Like I said, something is wrong when someone has an excuse for EVERYTHING. If he wants his refund, let him break it and take a picture of it. At least then you'd have the satifaction of knowing the thief wouldn't profit off it. As they like to say on these forums, "Pics or it never happened".
 

Like someone else said... I would have him send you Polaroid pictures in snail mail :thumbsup: Seems fishy to me, :icon_scratch: in the future you could put a disclaimer.. "NO RETURNS ON BROKEN MERCHANDISE" "NO REFUNDS WITHOUT ITEMS BEING RETURNED IN ORIGINAL CONDITION"'NO REFUNDS BECAUSE ITEM CAN BE SWITCHED OR EXCHANGED" 'SORRY NO REFUNDS !! This is the exact reason I don't do refunds... These sayings help a lot. I think they are not only legally binding but.. If not they are certainly deterring and will keep away most cons and will attract serious buyers... Also if he had a real problem, why is he not doing it by the book and contacting eBay like he should? Likely because he's trying to pull a fast one... However he has no Idea 10,000 treasure hunters got your back... :laughing7:

I will say what I say every time: If you are selling fragile stuff (or anything) on ebay, be prepared to assume the extreme risk that goes along with it.

In my opinion:

1. This guy is clearly playing games with you. Sucks but it happens.

2. I would probably just refund the guy's money and move on just be to rid of him.

3. Have you asked him what EXACTLY he wants you to do to resolve the problem? For future, try that first, sometimes people only want a partial refund or something like that.

I will say what I say every time: If you are selling fragile stuff (or anything) on ebay, be prepared to assume the extreme risk that goes along with it.

Its not really "personal policy". eBay gives me the option to allow refunds... I can describe my reasons for not returning no problem... :thumbsup:

Your story reminds me of the guy who tried to play the same game with me, except that the "USPS flat rate mailer 'blew out' and lost 7 of the 8 items that you sent."

I think my buyer, like yours, was fishing for a hefty refund. He played the same game about not sending pics, and not wanting to return the single item supposedly that was still left in the package.

After a series of emails, I told the buyer that I would refund when the single item arrived...and about 10 minutes later, left me the most glowing feedback I've ever gotten. I think it is strange that a buyer would eat $54 in car parts, and then leave fantastic feedback.
 

Well , I gave him his $12 & positive feedback - He gave me my first neutral - at least I'm still 100 %
