The resolution states, "Whereas the People and Council of the Borough of Frackville, Pennsylvania, while saddened and sympathetic to those people who have suffered tragedies related to the misuse of firearms, are also deeply concerned that these tragic events will be used as excuses to infringe upon the constitutionally guaranteed right to keep and bear firearms, firearms accessories or ammunition; all of which infringements are in violation of the Second Amendment to the Constitution of the United States and Article 1, Second 21, 'Right to Bear Arms' of the Pennsylvania Constitution."
FRACKVILLE - The borough council joined its neighbor Wednesday night when it declared support for the right to keep and bear arms.
The resolution, similar to one Gilberton Borough Council adopted in January, was passed with a 7-0 vote.
Councilwoman Karen Domalakes, who also serves as Gilberton's borough solicitor, explained the "Second Amendment Preservation Resolution."
"I forwarded a copy of the resolution to the council members that cites the Second Amendment of the U.S. Constitution and Article 1, Section 21, of the Pennsylvania Constitution, both of which deal with the right to bear arms," Domalakes said.
The resolution states, "Whereas the People and Council of the Borough of Frackville, Pennsylvania, while saddened and sympathetic to those people who have suffered tragedies related to the misuse of firearms, are also deeply concerned that these tragic events will be used as excuses to infringe upon the constitutionally guaranteed right to keep and bear firearms, firearms accessories or ammunition; all of which infringements are in violation of the Second Amendment to the Constitution of the United States and Article 1, Second 21, 'Right to Bear Arms' of the Pennsylvania Constitution."
Domalakes said the safe and proper use of firearms is also addressed in the resolution.
"It would be our policy to cooperate with responsible organizations, for example but not limited to the Boy Scouts of America, the National Rifle Association and others who promote the safe use of firearms," Domalakes said.
The resolution states that it will be the borough's policy to "adopt or enact reasonable measures to promote the education about the nature and safe use of firearms through programs developed and presented by its police department or other organizations in order to enhance the public safety and discourage the unconstitutional enactment of any federal, state or local laws, orders, rules or regulations in violation of the people's right to bear arms as guaranteed" by the federal and state constitutions.
