Dredging in North Carolina National Forest on Private Property?

There is NO federal land ( for a example,except for land that the White House sets on)! it is ALL public land maintained by a federal agency, most of such think they own the land! They don't! They use public $$ to buy , maintain it and pay their salarys! asking most federal employes about the mining laws will get you "their" version , or what they've been told to say!

Political inclinations aside Russ, I think you know there's a distinction between Public Lands which belong to all of us and lands purchased by the Feds from a private party. The latter lands are associated with a deed of title and are treated as being owned by the government including being outside the mining laws. This includes all the national forests in the eastern US.
 

Kev I completely understand what your saying , and respect your views opinions , BUT if a gubermint agency , Federal , state ,local that buys land with tax moneys makes that land public land! their may be certain laws enacted towards this land or special restrictions applied to that land if it is in the sale papers , but it all is public land! they can call it what they want...............it was our tax moneys that bought it!

If you have permission from the land owner and he owns the property on both sides of the stream then you can dredge in that part of the stream.
It would be wise to keep a low profile and not draw attention to yourself,it seems that everyone is watching what everyone else is doing these days and with the land being in NF you may have visitors that you don't expect.

in your state I agree! but the laws in other states differ so everyone needs to check their own state laws. in My state (Misery) access to the streams ownership depend on what is on the owners land title. some have ownership of the streams bottom and others don't. and some don't own the shore line either! having this info on paper if checked by someone would be of immense help in keeping you from being cited!
 

It sounds to me that what you need clarified is EXACTLY where the line between the two properties is located. Is it on one side of the stream or the other? Does it run right down the middle of the stream? Until you can determine that information you're (pardon the pun) dead in the water. I'd ask the FS about the line and not mention a thing about dredging at all. Also while the deed to the properties should have that information on them, the FS may argue the point because they can. If I remember property law correctly, if a stream is considered the line between two sections, then the line is the middle of the stream. It may be different in your state so be sure to check.
 

like I stated in the previous post. In Misery the only way to determine where the property line is , is to look at the deed or survey....Each property line is different in this state. I agree with GI on his post!!
