Kerby Jackson
Chairman - Jefferson Mining District

When will we finally, as a group, stand together against this criminal assault on a fellow miner?

Oh, so you're too busy huh?

I'll venture to guess that if it was your property stolen in an illegal act, you'd make the time to be involved...

There is power in numbers.. why can't most of you understand that?

Mr. Hepfner,
As a reminder, in order to work your mining claim, you will need to have an approved Plan of Operation (POO). Please work with my office to get an authorized Plan of Operations for your mining activities at your earliest convenience. Until you have an approved plan, any mining activities, associated equipment or occupancy of National Forest System lands is prohibited.

I look forward to hearing from you on this matter.
Sincerely,

It would certainly be interesting to see what other miners had to present for a plan of operations, and what kind of timeline they had. Things do change but why now, only after this snafoo? Hope things start going better for you.

I think it's time to have your attorney send of a letter. Just tell them you dont need a notice of intent for dredging and see how that gets there goat.

Complete and utter FS BS that letter is. Now add harrassment on top of it all, what. Take great care in what you chose do, as Hoser was saying, seen this before and they will be on you like flies on sh...

I would send them a "statement of facts" letter stating that you don't need a POO since your are only mining with hand tools and will have no significant impact (NSI). This should be a letter stating the facts, you are informing them of the facts, and you are not asking for their permission, approval or applying for anything.

Wish you the best.

I made the calls that you needed come on people think if it was your problem you would be begging people to call take a few minutes today to help the government just TOOK his land Please help it is just a few phone numbers and if enough of us call we could really help this family

Thanks for your support Jd, but we are past that point of calls and I am working on a response to their letter.

so,public lands supported by our tax dollars, and with valid claim to same, are considered by this joker to be the kings land, and off limits to you without approved poo.(p).kinda like scotland was,the fish in the waters owned by the nobles, and not to be touched by the common people.who literally starved to death as salmon swam past.hefty,am calling this guy tommorow,i will first state to him that i am in no way involved with your case,.only then will i chew his ass to pieces, the swine.I certainly do not want to make things harder for you,but this pisfur willy has it coming to him.non american dictators like him should not feel safe while oppressing those they are supposed to serve, and who pay their wages to boot.usfs=UrSureFullofS..t

need to dig up my federal statutes and do some reading, but i seem to recall that usfs (dept. of ag)which along with blm (d. of interior) administer american public lands, are not the legaly designated regulatory enforcers/creators of u.s. mining laws.i may be completely wrong here,or newer statutes written that im not aware of,but i think that usfs was only intended to have limited authority over miners upon public lands,BLM was designated as the oversight of mineral ops on american public lands.you know, couldnt hurt to not refer to these lands as" blm land"or "fs land"rather, public lands,or,OUR lands.but fs,over a period of time ,got people to accept more and more rules/regs,until like a schoolyard bully allowed to xtort milk money from his victims, think that they are a law unto themselves.just as the bully, who is meekly handed the milk money day after day, thinks that he is entitled and deservirng of same.the usfs over a period of time has become a nightmare in many ways.i have seen them burn around 100 houses in my area over the years, but cannot recall of anyone being compensated after their homes/lifelong possesions were destroyed.often intentionally, but always in negligence.feds dont fight fires, they "manage fires",in their own words.am afraid that fs,like a long tolerated schoolyard bully, needs to see us kids bringing baseball bats to the games.and drinking lotsa milk.sorry off thread, best wishes

If you look at a map of the Western States you will see that BLM land and FS land are two different colors, WHY? It was done that way so when you look at a map it doesn't show how much land the FEDS really own, It's all the same just managed differently as a COVER UP.

I am with you 100%.....

The feds OWN nuttn' as they are hypothetically pathetically the STEWARDS of the public lands, yaaaa as in Gestapo and each little forest king(area stupidviser) runs their own op in direct accordance to their sic preconceived notions, beliefs and delusions of grandeaure..... F'M' all and go have a ball and catch me ifn' ya can mo'fo' cause off I go...John

I'll refrase that, They are supposed to manage "ALL" that land. Yes John you are right, and I agree with you.

From SWOMA.
Would not hurt to let them know they are being watched.
As I do plan on going back to work. As John would say.........F* M*!!!

USFS Terror: USFS Fails To Learn Their Lesson
Readers will well remember the debacle in Placer County, California where employees of the United States Forest Service stole mining incident tools from California miner Mark Hepfner. USFS had no warrant for the gear, nor did they give Hepfner notice that his property was under threat. Criminal complaints filed by Hepfner with Placer County Sheriff's Department were ignored, as were legal notices to the United States Forest Service.
Miners from around the country came to Hepfner's aid, promptly applying pressure to the United States Forest Service and the Placer County Sheriff's Department through varying tactics. Eventually, Congressman Tom McClintock's office intervened and after catching USFS in certain "little white lies", was able to force the United States Forest Service into returning Hepfner's property (minus the property they destroyed, of course). It also appears that the Placer County Sheriff's Department ignored Hepfner's criminal complaints for the simple fact that they supplied the helicopter that was used to steal Hepfner's property and had colluded with the USFS to commit theft and to deprive Hepfner of his rights.
One would think that USFS District Ranger Chris Fischer would be a bit embaressed about all of this and would think twice about violating Hepfner's rights again. Instead, Fischer recently fired off a letter demanding that Hepfner "work with (his) office", insisting that "any mining activities, associated equipment or occupancy of National Forest System lands is prohibited" until Hepfner does so. In otherwords, Fischer is now prohibiting Mark Hepfner from enjoying his property rights, which are protected by the 1872 Mining Act and by the United States Constitution.
Once again, we are requesting that miners come to Miner Hepfner's aid. Please call USFS District Ranger, Chris Fischer at: 530-367-2224 and tell him to stop violating the rights of miners. We also suggest that you contact the office of Congressman Tom McClintock at: (916) 786-5560 or (202) 225-2511 as well as Congressman Doc Hastings, who is the Chairman of the House Committee on Natural Resources: (202) 225-5816 and let them know what the United States Forest Service has been up to.

Some think that CJ Roberts is doing a stealth maneuver bo guarantee Obama's diselection, I ain't one of them. Every chance you get question the people running for any office on their opinion of the constitution. If they say it's a living doc. or we have moved beyond it, scratch them off the list they are big gov. socialist types. Only staunch constitutionalists need apply.

Now back to prospecting.
