There’s no hurry you can fill out the DSL online permit application anytime between January 1st and February 28th
you will have to research where you want to dredge as you have to choose three spots to mine only,
only choose a spots that are in ESH, if its not ESH you don’t need a DSL permit for instance places like Quartzville, Brice, a lot of the Umpqua.*
Only the owner of the dredge need apply should be more to go around that way.

There was a lot in SB838 that couldn’t be reconciled with existing laws.
SB838 does not say to create a new permit, the DSL permit is for mining within ESH
If it’s not ESH you don’t need a DSL permit.
Written into the law, the definition of removal/fill on non-ESH streams is equal to or exceeding 50 cubic yards at one location.
OAR 141-085-0510 (37)&(82) less is exempt.
also not applicable is the 100 yards above the ordinary high water (OHW) line they don’t have jurisdiction
as “waters of the state” is only to the OHW line. Dredges may remain anchored if it is moved close to shore as long as the responsible party is nearby,
no obstructions to navigation.

The DEQ discharge permit is the same no limits on numbers but comes with a $150.00 surcharge

For renewals write DEQ NPDES 700-pm and permit number on your check for $25.00
plus the surcharge form and payment.
High bankers; you’re supposed to get the individual NPDES permit $300.00 one time application fee, $25.00 renewal.
The reasoning is you may be adding material into the stream. Some just use the 700pm and call it a dredge,
allowed up to 10 feet outside the wetted perimeter in non-ESH or within the wetted perimeter in ESH.
Best option is the WPCF 600 permit (free) and use a holding pond or contours of the land.
