I bet they will win, if I wore hats mine would be off to them :)

Rumor has it that their case will be placed on hold for six months and then dismissed. Once again the State is pimping and pandering both the law and the judicial system.

Would be nice if they could sue the state for dragging it's feet. Sucks that it would be our tax money but it's the only thing the state cares about.

Everyone has a right to a speedy trial. If the accused waive that right the case can, and will, drag on for months/years.

If you have been arrested without a warrant demand to be taken before a magistrate immediately for a probable cause hearing.* Immediately means when you are arrested not after booking or holding cell!

You have the right to get justice NOW. Don't wait around for the arresting officer or the State to get their story straight. Do not sign any papers. Do not make any statements, keep your mouth shut, make the State prove it's case. Insist on Due Process.*

Every delay in the legal process has to be agreed on by the accused. Stop agreeing to delays and start holding the arresting officers feet to the fire. If they can't prove to a judge legally why they arrested you the case is over - you go home with no record and the cop wasted his day and POed his chief.

You can win these cases but you can't keep doing the things you've done before and expect different results. Educate yourself and prosper!

California Penal Code 849
(a) When an arrest is made without a warrant by a peace
officer or private person, the person arrested, if not otherwise
released, shall, without unnecessary delay, be taken before the
nearest or most accessible magistrate in the county in which the
offense is triable, and a complaint stating the charge against the
arrested person shall be laid before such magistrate.

if only they would catch you while dredging ,california dredgers might be in the water tomorrow8-)

Six month continuence, if no citations, case dismissed. A decision on Rhinehart will expedite that dismissal. If injunctive relief, TRO is issued by Ochoa, then they are free to get back in the water. Once again, the state wastes the resoursces of the taxpayers at the behest of the green facist.

this has to stop. the state closed my spot at lost lake calling it a bird reserve . finger up

The DA is being pushed by the state, he wanted nothing to do with this case, and now he is all fired up to prosecute.

Never doubted it for a second. Persecute miners as they empty the prisons and nuthouse onto the street to rob, rape and pilage. Stats out NOW that absolutely proves it. Criminals can't be held in jail as they are over fed max allowed so open door policy. Our local rag keeps count as some up to 6-7 felonies THIS YEAR ALONE and put out on the street every time as fed mandate rules them too due to overcrowding. Got plenty of cash to prosecute dredgers but crankster gangsters, pot cartels, honey oil labs, robbers, rapists, we'll try them next year after they do it a dozen more times...sic sic sic sic :censored: John
