"Prospectors" is not defined only cross reference made in the code for Oregon.

"Grubstake contracts" have to be "Recorded" in order to have any standing.

"Mine" is clearly defined.
 

"Abandoned claims deemed unappropriated mineral lands; Obtaining title irrespective of work".
 

Maybe just one "Prospector" out there can help fill in the blanks here?

Minerals /timber/ etc. and when you find what your looking for and start to accumulate it by digging /cutting /etc. then you are a miner and your mining that item after you get your permits and jump through the hoops ! The mining laws pretty well spell it out.

Good points you make. The down side is that "The State" is not aware of this activity unless there is "Affidavits" of these types of actions / activities. In other words first hand know age thereof.

A fictional "arising" creature cannot be involved in first hand know age of the acts thereof.

The only "Case Law" I could find on the topic of "digger for metals and other minerals" is two Colorado cases that only refers to "Miner" and "One who mines".
So far there is no definition of "Prospecting" within "The State of Oregon" and likely "The State of Colorado".
 

Can anyone point out some "Oregon Case law" that tells what a "Prospector" is except as a "Grubstake"?

There is a reason for the low "Prospector" content here. Just take a look at "The State of Oregon" code.
 

Since this word is not defined you can make it anything you chose to be.
