Order granting publication for Rinehart case has been filed!

The 3rd Appellant court has granted our request for publication of the Rinehart case. The Order was filed today by Judge Hull.

Thanks to everyone who has done their part in sending in letters to the court.

It doesn’t allow the laws to be overturned
But It does set precedence that other courts will have to follow.
That the courts have to look at testimony and evidence of at least these two questions:
(1) Does the laws prohibit the issuance of permits that are required?
(2) If so, has this de facto ban on suction dredge mining permits rendered commercially
impracticable the exercise of defendant’s mining rights granted to by the federal government
.

WHAT D LL-DISPOSITION-----The judgment is reversed and the cause is remanded to the trial court for further
proceedings. What ever happened to the DOUBLE JEOPARDY laws as in you can't try a man twice for the same crime,which it was not??
