N.Y. State Land?.....DEP?

I have done very limited MD'ing on NYS forests. I was told it is public land and OK. Whether this is true for all areas ???? Best to call the local DEC office and ask. Most people have to idea what you're talking about and just say OK :D Just make sure not to leave evidence of your digging and we should have access for years to come.

thats the DEC department of enviormental conservation. and detectign is allowed on ny lands at the discretion of the DEC. we have a 50 year antiquitie rule. all artifacts on state lands belong to the history museum in albany. these laws fall under the dept. of education. and they are sticklers if you get busted. one guy i heard of up north found an 1812 was ship anchor. he spend 50k in the state courts and won. NY confiscated the anchor anyway and appealed to the federal courts.

waste of tax payers cash after we conquer congres we must appeal to the state level to get rules changed define "historical artifact" and limit the acrcheologist time spent on a site and then yield the site to hobby hunters. even if stuff gets documented and if the archs want somethgn they can buy it from us.

NO, NO, NO...DEC is Department of Environmental Conservation (law enforcement agency dedicated to environmental conservation in NYS. DEP is the Department of Environmental Police (NYC law enforcement agency dedicated to the protection of the NYC water supply among other things)

NYS land yes. DEP land is a big NO NO as far as I know. I have spoken with some of them on the phone and they said "no". I have heard doing anything against the rules can get you a trespassing charge, and a trespassing charge on DEP property carries a terrorism charge with it. Thank you Osama, you p&!*k. I would check with DEP before you go hunting, and if you hear any different, let me know. I am really interested in detecting some DEP property if it's not against the rules too! Here's a link, and buried in there somewhere, I think it's 16-16 (i), is a clause about no activity being allowed that isn't expressly written in the rules.

Here is a rule to live by;

If it is state or federal property then it is best to stay off it unless you yourself have permission in the form of a permit or personal contact with the guy in charge. Preferably the first. Without it you are fair game for whomever decides they don't want you there. They can throw whatever they want at you. Trespass, theft, vandalism and any number of charges under vague archaeological and historical protection laws. Even if you somehow manage to win you will probably be flat broke and in debt to lawyers for life.

Is it right? NO. But that is the way it is at this time.

I have heard that since Sept 11, trespass charges carry a terrorism charge if they are on city drinking water land...trespass is a piddly charge compared to the hefty jail time and fees that you could get with a terrorism charge. Punks.

Thinking about getting a a GTI 1500 soon. Good for a starer unit???

So it sounds like I can't just run down to the Texas San Jacinto Battleground State Park and whip out my brand new detector and start swinging, huh?

Nuts. Do they ever give permission to individuals or have the clubs already worked the area over for the historical societies?
 

Stay off TX state land. Detecting is not allowed. Also as a general rule stay off of any public property that is historical.
