Louisiana Lawmaker May Have Found Way Around Assault Weapons Ban

While Congress debates a ban on so-called assault weapons, a Metairie lawmaker wants to make it so that residents of Louisiana could still buy and sell them, even if the proposed ban becomes federal law.

State Rep. Joe Lopinto says the key is the interstate commerce clause of the Constitution, and having gun makers set up shop in Louisiana.

"If you manufacture a weapon completely within the state of Louisiana and only sell that to Louisiana residents themselves, that does not at that point in time become interstate commerce," Lopinto said.

He's prepared a bill to create a state license for making and selling firearms within state boundaries only that he says would supplant the federal licensing system.

"If that gun manufacturer wants to...manufacture that gun completely in Louisiana, they can sell to Louisiana state firearms dealers, and then a Louisiana resident can purchase those residents from them," said Lopinto.

Isn't something like this being considered in Wyoming or maybe it is Montana? Sad that we may have to resort to loopholes to preserve the original intent of our Constitution.

Gun grabbers in Congress are hacking away at the Constitution in little chunks. The chatter currently somehow has morphed their definition of assault weapon from the scary looking military style rifles to anything with a capacity of more than ten rounds. My old 22 semi-automatic rifle has a tube capacity of far more than ten rounds. If the gun grabbers are successful in redefining assault weapons only by ammo capacity then a lot of us will own "illegal" guns.

I'm vehemently against messing with our Constitution, but strongly supportive of heavy mandatory penalties for criminals who use any weapon (gun, knife, sharp stick, etc.) to committee a crime. Bottom line ... it is the criminals who must be dealt with. Congress does not seem to be interested in addressing the real problem.
