Legal: Mineral rights (and the drinking of milkshakes).

Cliff notes: Oil/Gas company is drinking my brothers milkshake without permission and paying paltry.

So my brother has about 30 acres in an area that has recently seen a lot of activity regarding drilling for oil and gas. The drilling company came out and asks if they can put in a 'tap' in the ground on various properties around this town. When they asked my brother, he said no. He doesn't want it on his land. However, his nearest neighbor with 300 acres said yes.

So, this neighbor who has 300 acres is now getting something like $30k every 3 months because they found a pocket of natural gas and are now taking it. However, because this pocket of gas also goes under my brothers property, they are paying him $400 every three months. He never gave anyone permission, but, I'm guessing it's allowed? (to drink milkshakes?).

Another question I have, if they're paying $30k for 300 acres, wouldn't 30 acres be 1 tenth of that ($3K instead of $400)?

Any good tips to consider (besides to seek an attorney).
 

Hey Mike, Because the main pocket is under the neighbors land they will get the major amount of money...however, your brother does have more rights to a bigger share of the money, unfortunately, he will have to get a lawyer to get it...Tell him good luck...
