How to go about it?

A fella approached me today, knew me, and knew I metal detected. Long story short. He rents from a guy I know. The property was owned by an old one. When the ol one passed away, there was $60K found in books in "his space". The guy who inherited the property was told by the ol one, where he had buried his treasures. A few have been found (gold coins, Kugerands, ect) Evidently, there are a few more. The ol one, spent most of his life looking for gold. When found, he poured into bars and planted, in PVC pipe, in the ground for prosperity. Didn't live long enough.
My question, I was offered 30% of the finds, by the renter (caretaker). My first thought is to get it all in writing, including the owner of the property now. Would that be enough? I know the owner and would trust him on a handshake, the renter, don't know? Just got this proposition today, so haven't had time to check it out with owner of property. I guess they have an arrangement already, cause the caretaker has been digging holes for the last 6 years. Targets probably deep. Have a ML4000 with a 42"x24" coil, mounted on a pvc "push-mower" setup (which adapts to a pvc framework, I pull behind my quad at Rye Patch).
Any suggestions on legalities, would be appreciated.

Well I know if your agreement is with the renter and not the owner, it will not hold up in court if the owner finds out about it and is not happy. The renter is not the owner of the property.

That is a tough one. I think you do need to go to the owner of the property.

I am sure others might say if the owner does not know it does not matter if he does not find out.

Personally I would deal with the owner only, although that might make the renter unhappy and he could make things difficult for you. So who knows, that will have to be your decision.

Regardless if you deal with the owner or renter or both I can email or PM you a Search Agreement that will hold up in Court.

Whoever you deal with, you need a Search Agreement

I've been thinking about this type of situation too. I agree with eric, got to have the owner involved. Maybe whatever agreement the owner and the renter have can be amended to include you. It sounds like there is enough to go around. It sounds like the renter is offering 30% of his cut. You might be able to get a better deal. You are certainly bringing something to the table.

I'd like to see a picture of your setup, too

Happy birthday Shep. I have a GPX-4000 that I purchased (traded in my GP-3000) to a Minelab dealer in Idaho thanks to your good buddy Gary (Grubstake). I decided on the 4000 because the gold in Virginia is small and located in highly mineralized areas. It will probably take a rocket scientist to learn to use it. I have 3 day of training that I can get on it, but I would rather learn in your "neck of the woods". Also, I purchased a Minelab Explorer SE for relic hunting in Virginia. I have an opportunity to detect a farmers field where some of Lee's men camped out on just before surrender at Appamattox, Virginia. Question, how can I rig-up equipment (like some people do for meteorite recovery) for recovering civil war items on open fields, either by atv or rigging up a deer cart. The goal is to cover as much ground as possible with each pass. If anyone can help, please send me a PM. Thanks, RuffandTuff.

Put a post up last night, but it's not here. Wouldn't go on the property without talking to the owner and his permission. Would use eric's form to cover my bases, but if a handshake wouldn't hold up, why would a piece of paper.
My setup, damn, have to go back through the archives. Check my posts on AZO and maybe Nuggetshooter (Bill S). At Rye Patch, out in the open, very, very little trash. The coiltec coil (42x24), which I made up a frame for and can pull behind my quad. Frameworks made out of PVC. Have had a few problems, tongue broke, too close to quad, ect. Idea will work, although, the push (or pull) cart would be easier on all concerned, but more walking

Good luck with the searching. You know the people so if a handshake is good for you I am sure you will have no problem.

Here is what I did on my homebrew rig.

Lawnmower wheels and PVC. I put the electronics and battery on my belt. It keeps the frame lighter and easier to push. It gets harder quick if there is much vegetation.

Found pics of trolley and set-up for quad. The coiltec coil is 42x24. Doesn't seem to pick up small pieces of wire ect too bad (which is good!). I use another coil to pinpoint with
