Florida Waterway

Wouldn't that depend on who owned the particular stretch? I mean, don't they cross through a myriad of different entities: city, county, state, fed, private, etc... And depending on what you're referring to as "inracoastal waterways, that is, .... do you mean any ditch and/or all canals, etc...? Or just the navigable ones for shipping? or ....?.

from what I understand the state owns all waterways

If you're going to dive, you have to make sure you're not a hazard to navigation. You should check with the agency in charge of that particular waterway.....i.e. Coast Guard, Harbor Patrol, etc. Or you could just do it and wait until they yell at you! Never heard of anyone being cited for it. Just tell them that your wife lost her wedding ring overboard and you're trying to find it.

Mark, when you advise gsxraddict to "check with whatever agency owns that stretch", that sounds like asking some desk-bound person "can I metal detect?" type question. So rather than doing that, can gsxraddict accomplish the same thing, by looking up any rules or laws for himself? Example: if it were a county owned stretch, the certainly county rules and codes are on their website. If he looks there, and sees nothing saying "no metal detectors", then presto, there's his answer, right?

And seriously .... unless there were some sort of historical monument, or gsxraddict were being some major nuisance in some other way, .... does anyone really care?

That was kinda my point but I just didn't express it too well. You may have to ask a "desk-bound person" about who has control over that waterway but then look up the codes yourself after you find out. I think if you just stay out of the way and keep low key, you won't even be asked. If you are, just have a good story ready.

Waddya mean, 'Hunt the waterways'?

Wading in the water within the boundaries of the ICW, diving operations, towing a SSS or hunting redfish with a 30.06?

You are asking too broad of a question to give you a reasonable answer.

Walking around in chest deep water with my metal detector in the ICW. Not diving, not towing, and not shooting reds (haven't thought of that yet)

You can wade all you want with the detector. Just make sure you are not impeding the flow of boat traffic. You will get run over-

As long as you are not in an archeological site, have a blast.

I wouldn't ask anyone and just go do it. You act like metal detecting is some sort of illegal activity and not some form of entertainment. You don't ask if you can play ball or toss a Frisbee with your kids do you?
